The following Terms and Conditions of Sale and Use (hereinafter called the "Conditions") apply to :
The Anoli Joaillerie company (Simplified join-stock company) registered under SIRET N° 878 152 651 00013, with their head office located at the following address : 21 rue Armengaud 92210 Saint Cloud France (hereinafter, "we", "ours", "us" or "Anoli Joaillerie"),
and
Any natural person who is acting for exclusive personal purposes, who browses on www.anoli-joaillerie.com (hereinafter, the "website"), and/or place an order with Anoli Joaillerie (hereinafter "You", "Yours", "The user" or "The web user").
We recommend you to carefully read the Contract (as defined below) before using this website and/or before placing an order on Anoli Joaillerie as this contract affects your obligations and rights. The simple usage of the website and/or placing any order must be brought to your attention and get the binding agreement of the contract. If you do not agree with any of these provisions, you are not authorized to use partly or in its entirety our website to place an order.
Every functionnality or new eventual added tool to this store will remain subjected to this General Terms and Conditions of Sale. You can check on our latest version of the General Terms and Conditions of Sale at any moment on our page. We reserve the right to update, change or replace any part of the General Terms and Conditions of Sale and Usage by publishing the updates or the modifications on our website. It is your responsability to regularly check our page to review the updated modifications. Your continued browse on our website or your access to it after the modifications of any release constitute, an agreement of these modifications from your side.
Our store is hosted by Shopify Inc. They supply our e-commerce platform which allows us to sell our items and services.
ARTICLE 1 - GENERAL TERMS & CONDITIONS
1.1 SPHERE OF APPLICATION OF THE CONTRACT
Your website usage and/or any order placed with Anoli Joaillerie is exclusively and explicitely regulated under the Conditions, and any other terms and conditions or differently named on our website.
1.2 MODIFICATIONS OF THE CONDITIONS
The Conditions could be updated or modified at any moment, partly, or in its entirety, as it is explicitely defined that, when you place an order on our website, the applicable Conditions are the current ones on the website at the date of registration of your order.
ARTICLE 2 - PRICE AND PAYMENT
2.1 SHIPMENT COST
The price of our items are indicated in euros, VAT included. The shipment cost is free within metropolitan France. The shipping cost out of metropolitan France is indicated (i) either on our website at the checkout step where the delivery location's option is suggested (ii) or by phone or by email with our company for any other destination.
2.2 OVERSEAS SHIPPING
For any foreign order other than France, you are the importer of the ordered item(s). For any item shipped out of the European Union, the price will be excluding tax on the invoice. Customs duty, other local tax, import duty or state tax could be due. These duties are not under our jurisdiction nor our responsability. They will fully be at your charge and under your responsibility, both in terms of declarations and payment to your competent authority. We recommend you to seek for any advices to the competent authorities of your country.
2.3 INVOICE
An invoice of your order will be issued after the shipment of your order. It will be available in the client area of your website. You can also request this document by phone or email at your Anoli Joaillerie Customer Service.
2.4 PAYMENT CURRENCY
Every order is payable in euros.
2.5 PRICES CHANGE
Anoli Joaillerie reserves the right to modify their prices at any moment without notice, under the Article 1.3 quoted below. The orders which have been placed will be invoiced at the current price existing at checkout step.
2.6 ORDERS PAYMENT
You can complete the payment of your orders:
(I) by payment card (Visa, MasterCard, American Express or debit Card): the amount of your order will be debited within 7 (seven) days. The registration's date of your order is the one of your online payment.
(II) by Paypal : the amount of your order will be immediately debited. The registration's date of your order is the one of your online payment.
(III) by bank transfer : our website displays Anoli Joaillerie bank details. You need to make the required transfer which must appear within 7 days in order to place the order and get it registered. The registration's date of your order is the one of your online payment.
(IV) Via Partial.ly: by payment card, split up to 3 Months Free Interest Installment Payment (Visa, MasterCard, American Express or Debit Card)
2.7 PRICE DISPLAYED IN THE CART
The items placed in your cart will always reflect with the current price displayed on the descriptive page of your item. It is possible that this price varies with the price displayed for the same item when you placed this item in the first instance. Placing an item in your cart does not ensure that its price will be equal to the one at the moment you put the item in the cart. Moreover, there is a possibility that the items price that you selected would be lower at checkout than when you selected the item.
2.8 POSSIBLE MISTAKES
The informations including the prices which are displayed on the website could be wrong due to an error of the system or to the typographic filling. Even though we are carefully avoiding these kind of mistakes, they may exist. We do not honor an order issued with incorrect informations or prices. If the price displayed is inferior to the real price of the item, we will contact you by email to cancel your order or we will give youre related instructions to proceed with the payment of the price's difference. We apologize for the inconvenience, do not hesitate to contact us for any question related to that subject.
2.9 NON-NEGOTIABLE PRICES
The prices of our items are non-negotiable. Indeed, we are committed to practise the most possible fair price. The final price of our items reflects an inherent cost of raw materials such as metal and gemstones.
ARTICLE 3 - ORDER, ITEMS AND DELIVERY
3.1 CONDITIONS TO PLACE AN ORDER
You declare:
being at least 18 years of age and have the legal right to place and make an order or to have a parental permission which allows you to place and make an order and to be able to justify that matter at any moment, upon our request ;
being a natural person acting within your private spere (in that sense, each order you place must be related to normal needs of a private individual).
3.2 PLACING AN ORDER
We only acknowledge receipt of your order if the following steps have been respected:
1st step: You must enter the requested informations:
Your name and first name;
Your contact details (phone number and email address);
Your billing address (for safety reasons, we request that your shipping address is the one registered by your payment card's issuing bank in order to protect you from any fraudulent use;
Your exact shipping address (postal box are not accepted);
Your payment method.
2nd step : to submit your order, you need to:
verify the informations that you entered and correct possible mistakes;
tick the box confirming that you have acknowledged and that you fully agree with the Terms and Conditions of Sales and usage of this website.

3.2.3 RECEIPT OF YOUR ORDER
Anoli Joaillerie is related to the order only from the moment a receipt confirmation has been sent by us, in addition of the good reception of the funds related to your order on our account. On the other hand, Anoli Joaillerie reserves the right to cancel or refuse, without liability on their part, any order, upon just cause, in particular if a doubt or a dispute have previously taken place with the user.
3.2.4 MODIFICATION OF YOUR ORDER
Adjustments made with our care if the ordered item is not available:
Our items and prices are available within the limits of available items. If it was to happen that your order is out of stock. We are committed to replace it by an item with a quality at least equal or superior without modifying the price of your order. We will inform you as soon as we will be noticed of the unavailability of the item. Otherwise, we will notify you of the new delivery period and we will leave you to the choice of canceling your order.
We reserve the right to cancel the entirety or a part of an order in case one of our supplier is considered as defective but also in case of major force. We will inform you as soon as we are acknowledged of the case and we will proceed to the refund of the amount that you had already paid for the order or the part which has been cancelled. In any case, we will contact you as soon as possible to present you multiple options.
3.3 DELIVERY
3.3.1 INFORMATIONS
We inform you by writting of the manufacturing status of your order and of your order' shipment.
For any request related to the informations quoted below, please contact our Client Service :
Our identity (Name, Phone Number, Head Office), shipping costs, payment methods, execution or shipping methods ;
the terms and conditions of exercising your right of withdrawal ;
the address to which you can send the claims ;
the guarantees you possesss after delivery ;
the expected shipping date of your order and the delivery date
3.3.2 DELIVERY LOCATION
The items are delivered at the shipping address you have provided when you placed your order.
3.3.3 DELIVERY TIME
Unless the manufacturing, processing, shipping, or transit time is longer than expected (You will be notified after placing the order), your order should be delivered between 2 and 6 weeks maximum from the day you placed your order (view section 3.2.3 above). The delivery will be deemed at the date of the first submission of your order, at the indicated address.
3.3.4 DELIVERY DELAY
We invite you to regularly check the status of your order (view My Orders) or by calling our Client Service.
We will inform you of any shipment's delay which we may be aware.
If some of the orders are delayed among multiple orders you have placed, we are able to split the shipment. In that case, we will notify you with the arrangements that we are planning before shipment.
In the case that the package appears alterred or damaged, you need to decline it from the carrier and notify us with the rejection.
3.3.5 OBSERVATIONS ON THE DELIVERY OR THE DELIVERED ITEMS
You must verify the package and the items at delivery. If you have any comments or observations justifying the return of the items, please proceed as indicated in Article 4 below :
3.3.6 PROPERTIES - RISKS
The transfer of properties and risks of the items happens after the delivery of the products. However, in the following cases that :
(i) Your package has been returned by the carrier because of an invalid address or that you have not claimed it within the given deadline,
(ii) You have not answered to your phone or to our vocal messages notifying you of the situation (in particular if the email address or the phone number you submitted were incorrect) and we are therefore not able to reach you within a 3 months period starting from the shipping date of your package.
Anoli Joaillerie has the ownership of their items and is freely entitled to dispose them. Anoli Joaillerie registers the payments which have activated the manufacturing of the item and you agree to have no recourse to cover the amounts paid or the unclaimed items.
3.4 ITEMS MANUFACTURING
3.4.1 Anoli Joaillerie does their utmost to ensure that the online catalogue is as accurate and specific as possible. To increase the visibility of the item's details, they could appear bigger or smaller than they are in reality. Depending of your computer' settings, the colors could also vary.
3.4.2 Our objective is to offer you as much details and informations as necessary to provide you with the impression to know the item before it becomes yours. The displayed weight can also vary from 0,2 carats to the real weight of this same gem. Our manufacturing is crafted, it is therefore possible that some indicated measures on our pages could slightly differ from the one you are going to receive.
ARTICLE 4 - RETURN AND RIGHT OF WITHDRAWAL
4.1 RETURNS
Up to (15) days after the date of delivery (cf. 3.3.3), we offer the possiblity to return the item you ordered which would not give you full satisfaction for refund or exchange.
In that case, you must inform Anoli Joaillerie Client Service by writting before returning us the item, please indicate the reason of your return and carefully follow the return process that we provide you. Your request for return shall be effective starting at the moment Anoli Joaillerie acknowledges by writting of your request for return.
In the case of a return, the insurrance and shipping return's costs will be at your charge.
Upon receipt of your jewelry, we verify that it is in a perfect condition and we acknowledge receipt of your jewelry. Then, we will proceed to the refund corresponding to the value of the items within maximum (15) days following the date at which Anoli Joaillerie has accepted your request for return, also indicated at Article 4.3 below.
4.2 RETURN CONDITIONS OF ACCEPTANCE
The returns prescribed in article 4.1 above will not be accepted by Anoli Joaillerie and will not allow any exchange or refund, however it will occur if :
(I) the process of return described by our advisors and on our website are respected ;
(II) the items are returned in perfect conditions without being worn. Therefore, returned items that have been damaged, worn, soiled or altered will not be accepted. In particular, items showing scratches, even tiny ones, will never be accepted.
(III) Our specialists confirm that the setting and the gem, or any other building block of the item, are compliant with the item that has been shipped to you, without alteration, modification or any kind of intervention ;
(IV) the returned items must be unused with all original tags and accessories (original of certificate provided if it is the case, packaging, gift box, jewelry box, instruction booklets attached...).
We also specify that :
(A) Return is no longer acceptable if you accumulate 2 consecutive returns or cancellations.
(B) The items have been customized or modified on your specific request (in particular, when there is a size change for the gem or for different colors which are different from the ones displayed on our website catalogue) will not be exchanged or refunded ;
(C) Some special products such as "our limited editions" and "18K gold jewels" are not exchangeable or refundable.
(D) Moreover, items sold outside European Union will not be exchanged or refunded.
4.3 TERMS OF ECHANGES AND REFUNDS
Any refunds will occur at the discretion of Anoli Joaillerie, either by refund on your credit card, or by bank transfer to your bank account at the customer's name who has placed in the order, and being a resident at the address provided at the time of the order.
In the case of an exchange, the inital amount collected will be refunded. You will therefore be able to order a new item of your choice.
4.4 RIGHT OF WITHDRAWAL
In application of Article L.121-20 of the French Consumer Code, you are subjected to (14) clear days from the reception of the items to exercise your right of withdrawal without justification nor penalities. We will refund you up to (14) days at the latest following the date at which you exercise your right of withdrawal.
However, in accordance with the French Consumer Code, this right of withdrawal is not applicable to the items manufactured on special request, limited editions and 18K gold jewels made on request as mentioned in section 4.2 (C) above.
ARTICLE 5 - GUARANTEES
5.1 ABOUT THE ITEMS
Vermeil and Sterling silver jewels are garanteed during 3 months starting the day of delivery. 18k jewels are garanteed 1 year starting the day of delivery.
5.1.1 LEGAL GUARANTEES
Anoli Joaillerie follows the existing legislation related to the non-compliant items (Article 1641 to 1649 of the French Civil Code), the seller is given the lack of conformity of goods with the contract and flaws in critical conditions :
"Article L. 211-4 of the French Consumer Code : the seller must deliver a compliant item honoring the sales contract and be accountable for existing lack of conformity after being delivered. He is also accountable for lack of conformity caused by the packaging, the assembling instructions or the installation of the item under the contract liability or realized under his responsability.
Article L.211-5 of the French Consumer Code : To be compliant with the contract, the item must :
1° - Fit for the purpose usually of a similar property and, where applicable :
- Match the description given by the seller and possess the qualities that have been presented to the buyer as a sample or model;
- present the features that a buyer might reasonably expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling;
have the qualities defined by common agreement by the parties or be suitable for any particular purpose for which the buyer acknowleded to the seller, who has accepted it.
Article 1641 of the French Civil Code : The seller is bound with the warranty against any hidden defects of the item he sells that hinder the proper use of the product, or that so much diminish its use that the customer would not have bought it or would have offered a lower price if these hidden defects had been known.
5.2 ABOUT THE WEBSITE
Without prejudice to the provisions to be adopted by the Commission as laid down in Article 5.1 above, Anoli Joaillerie does not authorize any guarantee on the website and/or the contents (as laid down in Article 7 below). In particular, Anoli Joaillerie does not grant any guarantee as for the conformity of the elements of the website any particular purpose. Anoli Joaillerie does not represent or warrant that the functions contained in our website will be uninterrupted or error free, that defects will be corrected or that our web sites or that the server(s) which makes our web sites available are free of viruses or other harmful components.
ARTICLE 6 - RESPONSABILITY
6.1 COMPLIANT LEGISLATION
The jewelry displayed is compliant to the current French legislation at the moment of the proposition. Anoli Joaillerie can not be held liable for any non-compliance of the legislation in the country where the jewelry is delivered. It is your responsibility to check with the local authorities regarding the import possibilities of the jewelry which you envisage ordering.
Also, if you choose to access the website from other locations as France, you do so on your own initiative and at your own risk. It is your responsibility to respect the local legislation when this legislation is applicable.
6.2 JEWELRY PHOTOS
The jewelry photos are displayed for illustrative purpose only. We invite you to refer you to the description of each product to know the precise characteristics of them. If you need any additonal informations, please do not hesitate to contact us.
6.3 LIMITS OF LIABILITY
In case of gross negligence or wilful item default, the total responsability of Anoli Joaillerie, for the integrality of repairable damages under the contract's terms, which could potentially be caused by the contract's terms, is only limited to the repairs of predicatable direct material damages whether caused by you or by Anoli Joaillerie tort, this repair will in no way exceed the amounf ot your first purchase and that, even if Anoli Joaillerie is aware of the possibilities for such prejudices.
It is stated that, within the framework of the contract, any indirect damages will not open rights to repairs by Anoli Joaillerie, even though they could be predictable, any loss of data, profits, turnovers, data or software programs, savings, any additional charges, tainting of image or third's claims.
Anoli Joaillerie will not be held responsible for damages resulted by (I) your own fact, omission or fault; (II) any majeur force case such defined by the jurisprudence returned by the French jurisdiction; (III) any third part non-related to Anoli Joaillerie contract performance (for instance, in cases related to the performance, the congestion or the connection of the means or services of telecommunication, or related to the IT equipment performance); or (IV) any other event that neither Anoli Joaillerie, nor the suppliers could have anticipated or predicted even though Anoli Joaillerie or their suppliers have had the most reasonnable precautions.
In particular, it will be considered your own fact, omission or fault : any damage or loss that you would be subjected to, which would result from the maladjustment or the incompatibility of your computer device (device or software) partly or entirely from the website and/or the lack of reasonnable protection settings necessary to every softwares, devices or damaged connection. It is yours and only your responsability to, (I) verify or make it checked that your IT equipment and/or communication set-up are adapted and compliant to the website, and this, before usage and (II) to execute every necessary and reasonnable protections against any devices, programs or damaged communications, in particular thanks to anti-virus softwares.
6.4 LINKS TO OTHER WEBSITES

These websites are not regulated by Anoli Joaillerie and you acknowledge that Anoli Joaillerie is not held responsible to ensure the enforcement of intellectual property rights, neither for the legal aspect or decency, nor any other aspect of the website's content. The inclusion of such link does not imply any authorization from Anoli Joaillerie nor association with their operators. Anoli Joaillerie does not ensure that you will be fully satisfied with any product or service that you would seek on a third website issued from the hyperlinks from or destinated to the website, given the fact that other online business' canals belong to independant sellers and are exploited under their responsability. Anoli Joaillerie does not promote any products and has not taken any measures to confirm the accuracy or the reliability of any information displayed on thirds' websites. 6.5 PRESCRIPTION
Without prejudice to the provisions of the following article L.211-12 of the French Consumer Code and 1648 of the French Civil Code (recalled at Article 5.1.2 above) and other contrary legal mandatory provisions, you agree that any claims or action originated or related to the website usage (partly or entirely), must be formulated and executed judicially within a (1) year period following the first of the two following dates, otherwise the right of claim will become lost: the date at which the claim will be formulated for the first time or the date at which the cause of the claim had appeared for the first time.

The contract is subjected to the French rights ( excluding the rules applicable concerning the conflict of laws).
9.2 COMPETENT CHANNELS
In the event of dispute, the courts of Paris shall be solely competent.

10.1 PERSONAL DATA MANAGEMENT

10.2 RIGHT OF ACCESS, RECTIFICATION AND OPPOSITION
